6. This site contains reviews or statements about motion pictures that reflect the author’s point of view regarding the movies’ value to clarifying certain life issues. Some readers of this material may disagree with the views expressed by the author or find the films referred to as objectionable. For this reason the Motion Picture Association Of American’s (M.P.A.A.) ratings are given whenever available to guide the reader to the content and the films appropriateness for their viewing. These suggestions for film viewing are made to the adult visitors to this site. These terms shall be governed by, construed and enforced in accordance with the laws of the State of California, without giving any effect to its conflict of law provisions, as it is applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or C.B.S.I. bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in either the State or Federal Courts located in Los Angeles County, California, and you hereby consent and submit to the jurisdiction of such courts. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in a writing, signed by C.B.S.I.

TERMINATION

9. These terms are effective until terminated by either party. These terms will terminate immediately without notice from C.B.S.I. if in our sole discretion you fail to comply with any term or provision of this agreement. Upon termination, either by us or by you, you must destroy all materials obtained from this site and any and all copies thereof, whether made under the terms of this agreement or otherwise.

PROPRIETY DISPUTES

10. If you believe that material on the Site violate proprietary rights, including copyright, trademark, trade secret, right of publicity, or other intellectual property rights, please send C.B.S.I. a letter that includes:

(1) A statement that you are either the owner of such alleged rights or an explanation of your relationship, if any, with the owner of such alleged rights, and whether you have the authority to contact C.B.S.I. on behalf of the owner of such alleged rights, include a statement of how you became aware that such rights allegedly existed;

(2) A detailed description of what the material, transmission, or communication allegedly infringes or how it otherwise violates a property or other right;

(3) A detailed description of the communication or content, the URL or location of where and when you find the text or content;

(4) If you believe that someone’s copyrights have been violated, please include the date when the work was first published, if applicable, the date when the work was completed, the date copyright registration was applied for and received, if at all, the registration number, and a description of the work as listed in the registration or application. In addition, indicate whether the work has been assigned or licensed to others, and who, if known, those parties are, and whether work has been involved in any litigation or other disputes.

(5) If you believe that someone’s trademark rights have been violated, please include the date the mark was first used in intrastate commerce and interstate commerce, whether the mark is registered with the United States Patent and Trademark Office, with an international registration system, or by a state, the date trademark registration was applied for and received, if at all, the registration number, and the description of goods and services in the registration or application. Once a meritorious letter is received, C.B.S.I. will undertake appropriate action, including, but not limited to (at C.B.S.I.’s) sole discretion: (a) temporarily or permanently remove, modify, or delete the material from the Site; (b) conduct further investigation; (c) temporarily or permanently deny access to the material.

If the letter does not contain all applicable information indicated above, the claim may be deemed meritless, unless the letter includes an explanation of why such information was not included. Once a complaining letter is submitted, if the party submitting the claim, or the party’s representative, is unwilling to engage in further communications or discussions with C.B.S.I. and provide C.B.S.I. with the information and materials necessary to complete its investigation, C.B.S.I. may deem the claim meritless.

Please note that C.B.S.I. will not necessarily acknowledge the receipt of the letter.

REVISIONS OF THESE TERMS

11. C.B.S.I. reserves the right, in our sole discretion, to modify, replace, amend, alter, or otherwise update or change these Terms at any time, and without notice by updating this posting. You agree to be bound by such modifications, alterations, and updates. Accordingly, Users should periodically read and review the Terms.
